This notice clarifies avenues for Tribal participation below authorities in the 2014 Farm Bill to develop industrial hemp for analysis purposes through the 2019 developing season. Below the 2014 Farm Bill, an Indian tribe can enter into a partnership or contract with an institution of greater education or a State division of agriculture each inside or in a distinctive State than the 1 in which the Indian tribe is positioned to create industrial hemp on the tribe’s land. For an Indian tribe to be eligible to do so, the State in which the Indian tribe is positioned and the State in which the institution of greater education or State division of agriculture is positioned each need to permit the production of industrial hemp.

The 2014 Farm Bill authorizes State departments of agriculture and institutions of greater education to develop and cultivate hemp for the restricted objective of conducting analysis below pilot applications.  Nonetheless, the definition of “State” that applies to section 7606 does not include things like Indian tribes. Indian tribes independently have not been capable to initiate their personal hemp applications below the 2014 Farm Bill and as an alternative have had to acquire a license or authorization below a state plan.

This potential below the 2014 Farm Bill to acquire a license or authorization from a State division of agriculture or institution of greater education positioned in a State other than the State of one’s residence extends to persons and entities that are not affiliated with an Indian tribe.  As is the case with Indian tribes, a State division of agriculture positioned in a State that permits for hemp production could license or authorize an person or entity that is not positioned in that State to create hemp for analysis purposes, offered that the State exactly where the person or entity is positioned also permits hemp production.  Likewise, an person or entity could companion or contract with an institution of greater education in an additional State below the exact same circumstances.

The law remains unchanged in that Indian tribes, people, and entities positioned in States that do not permit hemp production are ineligible to participate in the developing or cultivation of hemp below the 2014 Farm Bill plan.
